Conditions of participation and code of conduct

Conditions of participation for the Impact Day on 25/05/2021 as part of the European Impact Hero programme from March – December 2021 , the Center for Open Social Innovation gUg and Social Entrepreneurship BW e.V. (hereinafter also “the organizers”) allow European Impact Hero participants to participate in the program under the following conditions of participation.

Participation in the European Impact Hero programme

The European Impact Hero is designed for ventures and initiatives in Europe who want to develop innovative solutions to specific challenges in their business. Additionally participation is possible as a volunteer.

In principle, participation in the European Impact Hero programme is open to all ventures and people who adhere to these conditions of participation and the code of conduct at the end of the conditions of participation.

Registration on www https://impact-hero.eu is required to participate. By completing the registration, the participant submits a binding offer to conclude a free participation and usage contract with Social Entrepreneurship BW e.V. and the Center for Open Social Innovation gUg. The contract between: the participant and Social Entrepreneurship BW e.V. and the Center for Open Social Innovation gUg is concluded when Social Entrepreneurship BW e.V. or the Center for Open Social Innovation gUg confirms the registration of the participant(s) with a corresponding email.

All participants must be over 18 years old. The organizers reserves the right to refuse registrations in justified cases.

Contributions from the participants  

The participants agree to be assigned to one of the teams of the one-day event by the organizers based on specified skills and topic selection (division into teams of approx. 4-8 people). The organizers endeavor to assign all participants to a team in order to take part in the one-day event on 25/05/2021, but cannot assume any guarantees or responsibility for the assembled teams.

Social Entrepreneurship BW e.V. and the Center for Open Social Innovation gUg reserve the right to use the results of the event for their public relations work. All contributions by the participants are voluntary and waive any claim to remuneration. The participants have no right to the implementation or publication of their contribution other than inside their ventures business.

Participation in the European Impact Hero Accelerator program 

The modalities and criteria for participating in the European Impact Hero accelerator programme from June-November 2021 will be announced to the participants after the Impact Hero Day.

Image and sound recordings  

We would like to point out to all participants that image (also screenshots), film and sound recordings can be made during the online event or created by the participants themselves and submitted for evaluation by the organizers. These image, film and sound recordings can be created, processed and distributed as part of the organizer’s public relations work. By registering for the event, the participants declare that they agree that the image, sound and film recordings made in connection with the event may be used by the organizers for public relations without any claim to remuneration and in print media, their websites and social media channels and can be disseminated for the purpose of documentation and reporting.

Event cancellation and changes  

The organizers reserves the right to postpone or cancel events spatially and / or temporally. Furthermore, due to unexpected circumstances, a change of experts, speakers, volunteers or a change in the course of the event may be necessary. The organizers have the right to cancel the events without observing a deadline for reasons of force majeure or Covid-19 / Corona. In this case, all obligations of the organizers and the participants do not apply. Expenses already made with a view to participating in the event will not be reimbursed.

Granting of rights  

In view of the meaning and purpose of the programme to jointly develop innovative solutions for the participating social and sutainable ventures, all developed code or solutions are property of the partcipating venture who develops it (with the help of volunteers).

If the processing of the tasks affects the rights of third parties (e.g. software code, image rights), the participants must acquire the corresponding rights of use directly from the rights holder before publication or use takes place. The participants release the organizers from any liability for unlawful use of any third-party image rights. The participants guarantee that they have unrestricted rights for all content made available (software code, texts, images, materials, concepts, patents etc.).

The organizers do not (pre) check the content submitted by the participants, so the organizers assumes no responsibility for the form, correctness, appropriateness and quality of such content. As a precaution, the participants release Social Entrepreneurship BW e.V. and the Center for Open Social Innovation gUg from any claims by third parties.

Expenditure 

The costs and expenses of the participants in connection with participating in the Impact Hero Day are to be borne by the participants themselves. The organizer does not compensate the participants for expenses incurred in connection with participation in the Impact Hero Day. 

Further obligations of the participants

By submitting a contribution during the Impact Hero Day, the participants guarantee that the contribution does not infringe any third-party copyrights.

Participants: have all permissions, rights and licenses required to submit the entry in accordance with these terms and conditions, the entry does not contain any harmful, malicious or fraudulent code, including but not limited to bots, backdoors, Trojans, Worms and other harmful or malicious code, files, scripts, agents, or programs that aim to damage, adversely affect, stealthily intercept, or expropriate any system, data, or personal information, do not post any third party code or publicly available code which is subject to licensing terms that require the licensing of the product or any work derived therefrom to third parties or the making available to the public of the product or any work derived therefrom.

In the context of the program

Participants are also prohibited from Carrying out and / or promoting anti-competitive activities; promote, offer or distribute pornographic content or content that violates youth protection laws; To use the https://impact-hero.eu/ website for purposes other than those intended by using “robot”, “spider” or “offline reader” or other malware;

Disseminate content that is protected by copyright, unless: the participant has the rights to it or the necessary consents;

Disseminate offensive, racist or otherwise illegal content or information, including offensive or defamatory content, regardless of whether this content relates to other participants, the program, third parties or institutions;

To disseminate photos with defamatory, offensive, racist or otherwise illegal or immoral content;

To intercept messages or try to intercept them;

To advertise; to send messages that serve a commercial purpose;

Threatening other participants, harassing them unreasonably (especially through spam) or violating the rights (including personal rights) of third parties;

To use temporary e-mail addresses from so-called 10-minute mail services;

To use, publish or otherwise pass on data of other participants without their consent.

The participants finally commit to the code of conduct listed in the appendix.

A violation of the aforementioned obligations leads to the exclusion of: the participant.

Any other claims based on the behavior leading to exclusion remain unaffected.

Availability

The organizers do not guarantee the availability of the offer at any time. However, the organizers endeavor to make the website and the entire offer available for use as uninterrupted as possible. Social Entrepreneurship BW e.V. and the Center for Open Social Innovation gUg assume no liability for any technical downtime. Social Entrepreneurship BW e.V. and the Center for Open Social Innovation gUg also reserve the right to cease and terminate the operation of the website and or platform and the entire program in part or in total.  

Liability

Social Entrepreneurship BW e.V. and the Center for Open Social Innovation gUg ’s liability is excluded. Excluded from this are claims for damages of: the participant from injury to life, limb, health or from the breach of essential contractual obligations (cardinal obligations) as well as liability for other damage resulting from an intentional or grossly negligent breach of duty by the organizers, its legal representatives or Vicarious agents are based. Essential contractual obligations are those whose fulfillment is necessary to achieve the objective of the contract. In the event of a breach of essential contractual obligations, Social Entrepreneurship BW e.V. and the Center for Open Social Innovation gUg are only liable for the foreseeable damage typical of the contract, if this was caused simply by negligence, unless the consultant claims compensation for damage to life, limb or health. The above limitations of liability also apply in favor of the legal representatives and vicarious agents of Social Entrepreneurship BW e.V. and the Center for Open Social Innovation gUg if claims are asserted directly against them. The provisions of the Product Liability Act remain unaffected. various The law of the Federal Republic of Germany.  

Should one or more provisions of these conditions be or become ineffective or unenforceable, this shall not affect the effectiveness and feasibility of the remaining provisions of these conditions. 

Declaration according to § 22 KunstUrhG / Copyrigth law

By participating in the European Impact Hero programme, the participants renounce the right to their own picture with regard to the above item (according to §22 KunstUrhG, copyright law) and do not demand any payment for the above use. They do not derive any rights (e.g. remuneration) from consent to publication. They also consent to the processing of photos, sound and film recordings, provided these are not distorted maliciously. Image editing will be necessary but made for public relations reasons only.

This declaration of consent can be revoked by the organizers at any time with effect for the future. In the event of revocation, the recordings will be removed from the respective platform. If the recordings were available on the Internet, they will be removed if they are subject to the organizers‘ power of disposal. In the case of printed works, the consent can no longer be revoked as soon as the print order has been placed.

Code of Conduct

We want to provide a safe, comfortable environment and a non-violent experience for everyone, regardless of: gender, gender identity and expression, age, sexual orientation, physical or mental abilities, social origin, nationality, religion or political opinions, previous hackathon participation or lack of it, IT experience or not, selected programming language or tech stack

Expected behavior for the entire programme

Be yourself, be authentic, get actively involved and give and receive support. Be welcoming of people who participate in this programme and keep an open mind.

Be a part and contribute to this community in a positive way.

Act with consideration and respect.

Put cooperation before conflict.

Pay attention to each other! If you witness or supsect harmful behaviour, contact the organizers immediately but be considerate of other people’s right to privacey.

Alert the organizers if you notice a dangerous situation, a person in need or violations of this code of conduct, even if they seem insignificant.

We do not tolerate any form of harassment of the participants. Sexual language and images are not appropriate in any (digital) place, this includes the following points: hack lectures, presentations, check-ins, workshops or demos all parties associated with the programme, social media, all other online media and digital communication channels

Harassment and digital violence include verbal abuse, intimidation, stalking, tracking, photography or audio / video recording without consent, prolonged interruption of conversations, and unwelcome sexualized attention. Participants who violate these rules are asked to stop harassing behavior immediately and can be excluded from the programme at the discretion of the organizers. Contact the organizers at info@impact-hero.eu if participants behave inappropriately in the above-mentioned points.
